The Jet Gift Card - Terms and Conditions

The Jet Gift Card Terms and Conditions (referred to as the “Agreement”) describe the terms and conditions that apply to use of The Jet Gift Cards (“Cards”). This Agreement is between you, the Cardholder, and The Jet LLC, (“The Jet”). By purchasing, accepting or using a Card, you agree to be bound by this Agreement. If you do not agree with this Agreement, do not purchase, use or accept the Card.

A Note About Changes to This Agreement

Please note that this Agreement may change without special notice to you. Notice of changes will be by reasonable means, which may be by the posting of the revised version of this Agreement on our website. Your use of a Card after The Jet has posted the revised version of the Agreement constitutes your acceptance of the posted Agreement and will apply to your use of a Card from that date forward.

The date of the last update to this Agreement is always indicated near the top of the page and any change in the date of this Agreement shall constitute notice to you that the Agreement has changed.

• 1. Card Redemption.

  Cards are redeemable only for purchasing tickets offered by The Jet, excluding food and beverages and other on-board purchases. Cards are also not redeemable to purchase another Card. Cards have no cash value and may not be redeemed for cash (except as required by law). Cards have no value until activated. The Jet reserves the right to refuse to honor, or to suspend or deactivate a Card (a) in the event of a disputed credit card charge, bounced check or other failure of consideration or (b) where The Jet suspects that the Card was obtained fraudulently, in violation of this Agreement or in violation of applicable laws or other applicable The Jet terms and conditions.

• 2. Card Purchase.

  Cards can be purchased online at https://thejet.coach/ or via The Jet Concierge at 202-618-0612. All cards are eCards; there is no option to receive a physical gift card.

• 3. Balance Inquiry.

  For balance inquiry, please call The Jet Concierge at 202-618-0612. The balance you receive when inquiring is an estimate only. In most cases, the balance is adjusted immediately when you make a purchase, but there may be occasions when the balance adjustment is delayed.

• 4. No Expiration; No Fees.

  Cards do not expire. No fees for inactivity or service fees apply.

• 5. Not Reloadable.

  Cards may not be reloaded with additional value.

• 6. No Refunds.

  No refunds are permitted with respect to Cards. All sales of Cards are final.

• 7. Lost card details.

  Lost card details will not be replaced or replenished. The Jet is not responsible for unauthorized Card use.

• 8. Resale Prohibited.

  You may not sell a Card or otherwise barter for its exchange. However, you may transfer a Card to another person for no monetary consideration (e.g., as a gift).

• 9. Maximum Value.

  You may not purchase or obtain more than $10,000 in Card value in any one day regardless of location, whether on a single Card or multiple Cards. Moreover, you may not purchase a single card with a value greater than $500.

• 10. About Your Card.

  Cards are not debit or credit cards. The Jet is responsible for the operation and maintenance of the Card program. The Jet is the sole legal obligor to the Cardholder.

• 11. Cancellations, Modifications and Downgrades.

  A. If you purchase a ticket using a Card and you elect to cancel or modify your travel, The Jet's normal Terms & Conditions apply. You can cancel for a refund - minus a $5.99 processing fee - up until 2 hours prior to your scheduled departure time. Tickets are valid ONLY for the schedule, date and time for which they are purchased. All passengers must be checked in with an attendant five minutes prior to departure. Customers who fail to modify a trip at least 2 hours prior to departure or who do not board the coach at least 5 minutes prior to departure will be considered a no show and all fare will be forfeited. If a refund is permitted, you will receive a credit - minus applicable processing fees - by way of a voucher or promo code. Credit cannot be returned to the Gift Certificate. This promo code can be combined with remaining balance on your Gift Card at checkout. Promo codes expire one (1) year from the date of issuance.
  
  B. If you purchase a ticket using a Card and we cancel the trip for which your ticket was booked for any reason, we will send you a promo code in an amount equal to the purchase price of the ticket for the cancelled trip. This promo code will expire one (1) year from the date of issuance.

• 12. Assumption of Risk

  By using The Jet's services, you acknowledge and agree that your participation in The Jet's services is voluntary and involves certain known and unknown risks, including but not limited to, accidents or injuries arising from or related to The Jet's services and you assume all risk of personal injury (including death) or property damage that you may suffer while participating in The Jet's services.

• 13. Limitation of Liability

  The Jet is responsible only for transportation on its own lines in accordance with applicable tariffs and limitations and assumes no responsibility for acts or omissions of others, including interline partners, hotel partners, or parking lot partners, except as imposed by law. In no event shall carrier be liable for consequential or incidental damages for loss, damage or delay, including weather delays.
  
  By using The Jet's services, you voluntarily, expressly and knowingly WAIVE, RELEASE AND HOLD HARMLESS The Jet and all of its respective officers, directors, agents, employees, independent contractors, affiliates and other hired third parties, individually and collectively (the “Released Parties”), from any and all claims, whether known or unknown, liabilities, expenses, damages, and causes of action at law, or in equity, for any injury (including death) or property damage which you (or any minor passengers in your care) may suffer as a result directly or indirectly from participation in The Jet's services INCLUDING, BUT NOT LIMITED TO, ALL CLAIMS OF NEGLIGENCE, WHETHER ACTIVE OR PASSIVE, AND WHETHER CAUSED BY YOUR OWN NEGLIGENCE OR THE NEGLIGENCE OF THE RELEASED PARTIES. You further agree that this waiver and release extends to all such claims, expenses, causes of action, or lawsuits that could be brought by you, any minor passengers in your care, or your or their respective heirs or legal representatives. You will not institute or prosecute any actions or suits at law or in equity, nor aid any institution or prosecution of any claim, demand, action or cause of action against the Released Parties for any personal injury, property damage, or other loss or damage of any nature or kind, costs or attorneys' fees sustained or that might be sustained which are related to, resulting from, or connected in any manner with your participation in The Jet's services (except as relates to the wanton or willful misconduct of The Jet). In no event shall The Jet be liable for consequential or incidental damages for loss, damage or delay. You agree that this agreement may be pleaded as a complete defense to any action or proceeding that may be brought or instituted by you or your respective heirs or legal representatives. You further agree to INDEMNIFY, SAVE AND HOLD HARMLESS the Released Parties and each of them from any loss, liability, damage, or cost, including reasonable attorney's fees, which arises as a result of (1) your breach of these Terms & Conditions and/or (2) your participation in The Jet's services. All waivers, releases, and limitations on liability contained herein are agreed to by you in your individual capacity and on behalf of any minor passengers for which you have legal responsibility.

• 14. Unclaimed Property

  In the event you do not use your Card for a certain period of time, The Jet may be required to turn over the remaining Card balance to a state or jurisdiction under such state's or jurisdiction's unclaimed or abandoned property law. Although your Card does not expire, if The Jet is obligated to turn over the remaining balance of your Card under a state's or jurisdiction's unclaimed property law, by operation of law The Jet will be released from any further liability or obligation with respect to your Card and you may be required to contact the state's or jurisdiction's unclaimed property administrator to attempt to recover your unused Card balance. To protect your right to continue to use your remaining Card balance, The Jet will make reasonable efforts to exempt your Card from unclaimed property laws.

• 15. Governing Law

  The laws of the Commonwealth of Virginia, without regard to principles of conflict of laws, shall govern this Agreement and use of your Card. If any part of this Agreement is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions.
